This website is operated by SERKYEM Tea & Café, 217/3 Kabiguru Sarani, Near Bakultala More, Rabindra Nagar Main Road, P.O. Rabindra Sarani, Siliguri - 734006, Dist. Darjeeling, West Bengal. By browsing the site, placing an order or making a reservation, you agree to these terms. If you do not agree with them, please do not use the site.

You must be at least 18 years old and able to enter into a binding contract under Indian law. You agree that the details you give us — name, contact details and delivery address — are accurate and complete, and you are responsible for keeping your account password secure.

You agree not to:

• Use the site for anything unlawful or fraudulent
• Place speculative or fraudulent orders, or use stolen payment details
• Interfere with the site, attempt to gain unauthorised access, or scrape it by automated means
• Copy or resell any part of the site or our content

We may suspend or refuse service to anyone who breaches these terms.

We describe our teas and kitchen as accurately as we can, but tea is an agricultural product: leaf appearance, colour and flavour vary between harvests, and photographs are indicative rather than exact. All prices are in Indian Rupees and include applicable taxes unless stated otherwise. Prices and availability can change without notice. If a genuine pricing or description error affects your order, we will contact you before dispatch and you may confirm the corrected order or cancel it for a full refund.

Your order is an offer to buy. It is accepted only when payment succeeds and we send you an order confirmation. The totals shown at checkout are recalculated and verified on our server, and that server-side figure is the one that applies. Payment is taken through Razorpay, and every payment is verified on our server before an order is treated as paid. We may decline or cancel an order — for example where stock has run out, a pricing error has occurred, the delivery address is not serviceable, or we suspect fraud — and where payment was already taken we will refund it in full.

We ship across India through our courier partner. Charges, dispatch times and delivery estimates are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees, and risk in the goods passes to you on delivery.

You can cancel before dispatch, and damaged, defective or incorrect items are put right at our cost. The full position, including timelines, is in our Returns & Refunds Policy, which forms part of these terms.

A table request is a request only; it is confirmed when we acknowledge it by phone, WhatsApp or email. We hold reserved tables for 15 minutes past the booking time, after which they may be released. Please tell us about allergies or dietary requirements when you book — our kitchen handles nuts, dairy, soy, gluten and shellfish, so we cannot guarantee any dish is entirely free of a given allergen. Private events and large bookings are subject to a separate written quote and any deposit stated in it.

The SERKYEM name, the vessel mark, the site design, photography, artwork and written content are owned by us or used under licence, and are protected by Indian and international intellectual property law. You may not reproduce, distribute or use them commercially without our written permission.

If you send us a review, photograph, comment or suggestion, you confirm it is your own and does not infringe anyone else’s rights, and you give us a non-exclusive, royalty-free licence to use it to promote SERKYEM. We may remove any content that is unlawful, misleading or offensive.

The site links to and relies on third parties — our payment gateway, courier, maps and social platforms. We are not responsible for their content or their practices, and their own terms and privacy policies apply to your use of them.

Our teas and food are supplied for ordinary consumption. Information on the site about origin, brewing or ingredients is given in good faith and is not medical or dietary advice; if you have an allergy or a medical condition, please check with us and with your doctor. We aim to keep the site available and accurate, but we do not warrant that it will be uninterrupted, error-free or free of harmful components.

Nothing in these terms limits any liability that cannot be limited under Indian law, including liability for death or personal injury caused by our negligence or for fraud. Subject to that, our total liability arising out of an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, or for loss of profit, business or goodwill.

We are not liable for delay or failure to perform caused by something beyond our reasonable control — including strikes, courier disruption, landslides or weather affecting the region, power or network failure, epidemic, or government action. Where such an event causes a long delay, you may cancel an undelivered order for a full refund.

These terms are governed by the laws of India. The courts at Siliguri, District Darjeeling, West Bengal have exclusive jurisdiction over any dispute, subject to any right you have as a consumer under the Consumer Protection Act, 2019 to bring proceedings where you live.

We may update these terms from time to time. The version in force when you place an order is the version that governs that order, and the “last updated” date above tells you when this page last changed.
